Terms of Sale
In case of any discrepancy, the Estonian version prevails / Vastuolude korral kehtib eestikeelne versioon.
1. Seller
The seller of every work and publication offered on ehtekunst.ee is Ehted Inimestele OÜ (registry code 17048100, VAT No. EE102766983, Rataskaevu tn 20, Kesklinna linnaosa, 10123 Tallinn, Harju maakond, info@ehtekunst.ee). The artist is the maker and creator of the work; the work is given to the seller for consignment sale (komisjonileping). Your contracting party is Ehted Inimestele OÜ, not the artist.
2. Pre-contractual information (Consumer Rights Directive art. 6)
Before you place an order you are shown: the description and maker of the work; the total price including VAT; the delivery cost; payment methods; the delivery timeframe; the seller's details and the address for complaints. These terms are available and can be saved when ordering.
3. Prices and VAT
Prices are in euros and include VAT. The Estonian standard rate is 24% (since 01.07.2025). The price shown on the work is the final buyer price. The VAT portion is shown on a separate line of the invoice.
4. Placing an order and formation of the contract
An order is placed via the purchase form on the work's page. The order button is clearly labelled "Order with obligation to pay" (Consumer Rights Directive art. 8(2)). The contract is deemed concluded once payment succeeds; we then send you an order confirmation and a VAT invoice by e-mail.
5. Payment methods
Payments are handled by Stripe: bank cards, Link, Apple Pay and Google Pay. We neither see nor store card data.
6. Reservation
A unique work is reserved in the cart for 30 minutes. If payment is not completed within that time, the work is released for sale again.
7. Delivery
- The work is dispatched by the artist directly to the buyer under the consignment agreement, normally to an Omniva or Smartpost parcel locker.
- The delivery cost is shown as a separate VAT-inclusive line at checkout: Estonia €5, European Union €15. We do not ship outside the EU.
- The buyer's phone number is required for delivery, because the parcel locker sends the pickup code by SMS.
- Dispatch takes place within the stated lead time (3 business days by default; a per-work lead time is shown on the work's page).
- Ehted Inimestele OÜ is responsible to the buyer for the delivery timeframe, any damage in transit, and delivery of the work, regardless of the artist being the dispatcher.
8. Transfer of title and risk
The risk of accidental loss or damage passes to the buyer when the work is handed over to the consumer (or to a carrier chosen by the consumer) — §214(2) LOA (consumer sale). Title passes at the moment of dispatch simultaneously along the chain artist → Ehted Inimestele OÜ → buyer (time of supply for a consignment sale, §11 VAT Act).
9. Withdrawal and complaints
A consumer buyer has a 14-day right of withdrawal — see Right of Withdrawal. Every work sold carries a 2-year statutory warranty — see Complaints / Statutory Warranty. For these matters your contracting party is Ehted Inimestele OÜ.
10. Disputes
Estonian law applies; disputes are resolved in the Estonian courts. A consumer may turn to the TTJA Consumer Disputes Committee (ttja.ee) or the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
Legal basis: Law of Obligations Act §§208, 214; VAT Act §11; Consumer Protection Act; Consumer Rights Directive 2011/83/EU arts 6 and 8.
