Right of Withdrawal
In case of any discrepancy, the Estonian version prevails / Vastuolude korral kehtib eestikeelne versioon.
1. Who has the right of withdrawal
The right of withdrawal belongs to a consumer — a natural person buying outside their trade or profession. Businesses (B2B purchases) have no right of withdrawal.
2. Withdrawal period
You have the right to withdraw from the contract within 14 calendar days without giving a reason. The period begins on the day you, or a third party you designate (other than the carrier), takes physical possession of the work.
3. How to withdraw
To withdraw, notify us before the deadline with an unequivocal statement, in one of these ways:
- via the return form in your account at /orders/[order]/return;
- by e-mail to info@ehtekunst.ee;
- or using the model withdrawal form below (the form is optional — a clear statement suffices).
To meet the deadline it is enough to send your notice before the 14 days expire.
4. Return logistics (consignment specifics)
In the withdrawal confirmation we send you the return address — the studio address of the work's maker (consignor), disclosed only at that point. You send the work back there. Please return the work without undue delay and no later than 14 days from giving notice of withdrawal.
5. Refunds
We refund the purchase price and the standard delivery cost within 14 days of receiving the returned work (confirmed by the maker), using the same payment method you used. We may withhold the refund until we have received the work back.
6. Return costs and condition of the work
- The buyer bears the cost of return shipping, unless the work was defective or non-conforming.
- You are liable for any diminished value of the work resulting from handling beyond what is necessary to establish its nature, characteristics and functioning (§562 LOA). We may deduct such diminished value from the refund.
7. Manifest pricing error
If an order arose from a manifest pricing error (e.g. a technical fault where the price obviously differs from the true value), Ehted Inimestele OÜ may cancel the order and immediately refund the full amount paid.
8. Exceptions to the right of withdrawal (§53(4) LOA)
There is no right of withdrawal, among others, for:
- goods made to the consumer's specifications or clearly personalised (e.g. a commissioned piece of jewellery). Such a work is nevertheless covered by the 2-year statutory warranty;
- goods that deteriorate rapidly (not applicable to jewellery);
- sealed goods unsuitable for return for hygiene reasons once unsealed (not applicable to jewellery).
